cheers for the wife of suspended sheriff ross mercurini. good evening. i'm dan ashley. >> and i'm carolyn johnson. eliana lopez's testimony is crucial as the ethics commission is investigating her husband on charges of official misconduct. it all started with an

argument that turned physical on new year's eve. tonight eliana lopez spoke with poise from the stand about their relationship. abc7 news reporter leslie brinkley is live with more onst. leslie? >> a success speptionful night waiting -- a suspensionful night waiting for his wife to testify here. she had just flown in from venezuela where she has been since march. she left behind there her three-year-old son theo who is staying with her parents. eliana lopez was the star attraction, eliciting a celebrity reference among supporters. there was a heated hallway debate between attorneys on whether a restraining order would prohibit ross from being in the same room as his wife. but she walked into this chamber on the fourth floor of city hall. she smiled and winked at her husband as she faced the ethics commission.

>> how i feel? i feel so scared. >> even now you feel scared? >> absolutely jie. that you would lose custody? >> even though i am in venezuela. i am scared of all this madness. >> it was on new year's eve that an argument between the san francisco sheriff and eliana lopez resulted in a bruise on her arm. lopez says she confidently told a neighbor about the skirmish and the neighbor videotaped the bruising and called police. the scandal broke. >> she also said as a sheriff, it is a network and they will cover each other. you have to make an evidence, and you need something to protect yourself and fight in case you get in a custody

dispute. >> he was charged with misdemeanor domestic violence, but plea bargained to a lesser charge in false imprisonment. mayor ed leigh suspended the sheriff in march and now the ethics commission is hearing testimony that will decide his fate. >> lopez testified for 45 minutes tonight. her testimony will resume tomorrow at 5:00. she says she has to get back to venezuela by monday before an acting for a film rehearsal. she says she needs that job to make money for her family. reporting live in san francisco, leslie brinkley, abc7 news. >> the couple's son remains in venezuela. theo in this video with dan noyes. he went to meet eliana in venezuela in may. we will have more on her testimony when she returns to the stand tomorrow. the panel is expected to make its recommendation on the

sheriff's future to the board of supervisors on august 16th. breaking news in san francisco where a police chase ends in a crash. innocent people seriously hurt after their car is nailed by a driver trying to get away from police. alan wang is live on 6th and brandon tonight. alan, take us through what happened. >> san francisco police are calling this a sensitive case. here is what we do know. it started with a short police pursuit that ended after the suspect slammed into a vehicle and burst into flames.ndercover police say undercover officers were trailing a suspectg driving this suv. they called a patrol car to pull him over. he took off and spread down brandon street and t boned this convertible at brandon and 6th street. the two occupants were taken to sf general in serious condition. a police officer at the scene told me an off duty san francisco sheriff's lieutenant just happened to be in the area. so when the suspect jumped out

and started running, the sheriff lieutenant chased him down and arrested the suspect a block away. now, we also noticed a bullet hole in vehicle, ct's vehicle, but apparently that's one of the details that is case sensitive, and police are not commenting on it. again a fiery crash and police say the suspect seriously injured two innocent people before taking off and capturing them a block away. alan wang reporting live at 6th and brandon in san nk you,. >> thank you, alan. stabbing suspect shot by police in san francisco's financial district this morning died a few hours later at san francisco general hospital. police say the still unidentified manussed a box -- man used a box cuter to slash a man, a colleague, along the embarcadero, and then started walking south toward justin herman plaza. police caught up with him near washington and davis street. that's where an officer opened fire. he lunged at her with what looked to be a knife. a stabbing victim at the

chocolate factory said he barely knew the co-worker who slashed him, and the attack was unprovoked. a case of road rage was blamed for an accident that sent a fremont mother and her one-year-old daughter to the hospital. but thankfully they suffered only minor injuries. sky 7hd is overhead shortly after a driver lost control of his car at fremont and peralta boulevard. he jumped the curb and hit the mother and the little girl in a stroller. the white nissan was just out of control. >> started fish taling. there was no sign of stoping or slowing down or whatever. he comes up and hits the corner and hits the lady and her two kids. >> the other child, the five-year-old boy, was not hurt. the mother was released from the hospital tonight and the little girl is doing well, we understand, but she will be held overnight for observation. the 21-year-old driver from union city is in police custody. police say he had been part of a road rage altercation just moments before this crash.

police in vallejo are searching for two shoplifters who used pepper spray to get away. a man and woman were spotted shoplifting at kohl's in vallejo. the woman was seen here and then sprayed one of the employees in the face with pepper spray before taking off in a black chrysler see bring convertible. the license plate is a california plate 6viw642. if you see it you are asked to call police. this is surveillance video of one of five burglaries in the city of belmont in the past month. police are turning more to video like this to track down the criminals. strategically placed cameras are more helpful as homeowners turn to them for safety. one-third of homes have cameras and police are building a database to help them keep track across the city. the growing crime rate is not only in belmont. burglaries are on the rise in other cities including daly city, palo alto and morgan

hill. uc students dressed as zombies broke out their moves to protest tuition increases. it appears the students won, at least for now. the uc board of regents finance committee voted to freeze undergraduate tuition this fall. but the students could face a big midyear hike if they november. initiative in novemb. the man accused of shooting and killing an unarmed teenager in florida is speaking publicly for the first time tonight. george zimmerman talked about the night trayvon martin was shot in an interview with fox news. he said when he got out of his car martin approached him. as grab his to grab his phone he said martin punched him. he said martin said "you are going to die tonight" and tried to grab the gun zimmerman was carrying. zimmerman said he would like to talk to martin's parents. >> and i am sorry they buried their child. i can't imagine what it must

a popular fast-food chain is not getting the welcome mat. it already has an okay from the planning department, but now some people want that decision reversed. abc7 news reporter ama dates is live from the spot where chick chick-fil-a wants to open. why some people now want to stop them. >> dan, the chick-fil-a would go where this sizzler is on el camino rey'all. real. but some residents say they are against another drive through coming to their city, and they are really against chime-fil-a. chick-fil-a. he is a resident who doesn't want the chick-fil-a drive through in town. >> it brings smog, pollution, trash. we are bicycle friendly here.

the drive through people are eating and drive to the road. we have had bicyclist hit. >> there is is a perception that chick-fil-a's president is against gay rights, and the community doesn't want that business in their backyard. the restaurant was approved by the zoning administrator last week, but an appeal can appeal e made to put the issue before the city council. >> we want our democratic leaders to have a say. these are the people we elected to speak for us. they don't get a say unless we apply by appealing. the appeal process cost $1,000. >> to raise that money he set up a donation website to help the effort. but he says politics and gay rights don't weigh into this decision. >> the city council is going to act as judges, and it is not appropriate for any of us to make a decision because we have to give them their due process and not prejudge the issue. >> if enough money is raised for an appeal, the mayor says it comes down to this. >> the decision before the city council before -- will

doing more to bring health and nutrition to its customers. they are using a refrigerated truck brought by the community health fund to bring the food directly to the people who need it. fresh fruit and vegetables are being distributed in the low income communities where access to good grocery stores is a problem. the truck goes to 20 sites every two weeks. >> the success is great. we are getting 50 people, and our projections were to have 100 to 150 at a site. we will be there in a month or two. people were going back telling their friends and neighbors. it is an easy sell. >> clients will go home with an average of five produce items including collie flor, tomatoes, squash and more. the food bank of contra costa was the setting of the abc7 listens meeting. it is a chance for viewers to talk directly with us about what is on their minds. the discussion was hosted by the rn monthing anchor -- by the morning anch and and

you interesting weather right now. we have patchy fog along the marin county coast and right near san francisco, and look at these clouds moving in. high clouds. these are clouds associated with what was once hurricane fabio. they are now remanence of fabio. some of this has been resulting in a few showers developing in southern california, and this moisture has translated into high clouds for us here in the bay area. look at this view from the san jose camera this afternoon. the high clouds were coming in from the south. a beautiful view of the filtered sunshine. san jose 73 degrees. high temperatures in most areas running warmer. from our heavenly camera at 8300 feet, we did see some of the moisture moving in from what was once hurricane fabio. and if you are heading to tahoe oreo seem tee, you will want to -- or yosemite you will want to listen um. the temperatures are in the 50s and the 60s. patchy fog and high clouds. mostly sunny and warmer

tomorrow. hot conditions are expected this weekend with temperatures in the mid-nineties range. here is the low that provided us with the cool pattern. this is what is responsible with what is drying up this moisture from former tropical depression fabio. it was a tropical depression yesterday. it was once a hurricane, but not much left to it. a little warmer for your thursday. you will still see the high clouds coming into the bay area. so tonight just some patches of fog and don't worry about the greectual it is not actual drizzle. the fog will be limited in coverage across the bay. inland areas will be seeing the sun first. it is a warmer day tomorrow afternoon especially in the inland communities. we will see the cirrus clouds as we head into your thursday. in the sierra nevada a chance of thunderstorms like i mentioned from that moisture. so this chance continues tomorrow night, and then as we head into friday through sunday, a slight possibility of some showers and thunderstorms due to monsoonal moisture moving in there. tomorrow morning, cool in
